MODT in Home Loan: Meaning, Charges, Registration & Closure
Understand MODT in a home loan: what it means, when mortgage registration may apply, state-specific charges, documents, lender checks and what to do at loan closure.
Short answer: MODT commonly refers to a Memorandum of Deposit of Title Deeds, a document used in some mortgage transactions to record that title deeds have been deposited with the lender as security for a home loan. The exact document name, stamp duty, registration requirement and process can vary by State, property location and security structure. Borrowers should therefore treat the lender's written checklist and the applicable State registration authority as the controlling sources for the transaction.
For a home buyer, MODT is not merely a legal acronym. It can affect the amount of cash needed around registration, the documents that must be executed before disbursal, the lender's security creation process, and the steps needed to release the mortgage after the loan is fully repaid.
MODT in a home loan: the practical meaning
| Question | Practical answer |
|---|---|
| What does MODT stand for? | Memorandum of Deposit of Title Deeds. |
| Why is it used? | It records or evidences the creation of security where title deeds are deposited with the lender, subject to the applicable legal structure. |
| Is MODT the same as the sale deed? | No. The sale deed transfers ownership. MODT relates to the lender's mortgage/security over the property. |
| Are MODT charges the same across India? | No. Stamp, registration and related mortgage costs can be State-specific and may also depend on the security/document structure. |
| Does every home loan use the same MODT process? | No. The lender, State, property and type of mortgage determine the actual documentation. |
| What happens after loan closure? | The lender should complete the applicable document-return and charge-release process after full repayment, subject to the transaction and regulatory requirements. |
1. Why lenders ask for title deeds
A home loan is secured against immovable property. The lender therefore needs a legally enforceable interest in the property and will normally complete legal and technical checks before final disbursal. Depending on the transaction, the lender may hold original title documents and complete mortgage-related documentation to perfect its security.
This is separate from borrower eligibility. A borrower can have a strong salary, low FOIR and a good credit profile and still face a disbursal delay if the property's legal documents or mortgage-creation requirements are incomplete.
Before paying registration-linked charges, make sure you have the lender's final pre-disbursal checklist. The RiteAssetz home-loan sanction-letter guide explains why sanction and disbursal are different stages.
2. MODT, equitable mortgage and registered mortgage: do not use the terms interchangeably
Borrowers often hear several mortgage terms during a property transaction. They can refer to different legal mechanisms. A deposit-of-title-deeds mortgage, a memorandum recording that deposit, and a separately registered mortgage deed are not automatically the same instrument.
The correct question is not “Does every home loan need MODT?” but:
- what security is the lender creating for this property;
- which document will evidence or register that security;
- whether stamp duty or registration is required in the property's State;
- who prepares and signs the document;
- when it must be completed relative to sale registration and disbursal; and
- what release or satisfaction document will be required at closure.
3. What are MODT charges for a home loan?
There is no safe India-wide MODT percentage. Mortgage-related stamp duty and registration charges are governed by the applicable State framework and can change. The amount may also depend on the loan/security value and the legal instrument being executed.
When budgeting, keep these lines separate:
| Cost line | What it generally relates to | How to verify |
|---|---|---|
| Property stamp duty | Transfer/purchase documentation | Applicable State registration authority |
| Property registration fee | Registration of the transfer document | Applicable State registration authority |
| Mortgage/MODT stamp or registration cost | Creation or recording of lender security | Lender checklist + State authority |
| Legal/technical charges | Lender due diligence and valuation | Lender KFS/fee schedule or written quote |
| Processing fee | Loan processing | Lender KFS/offer |
Do not add an old MODT percentage from a blog to your purchase budget. Ask for the actual payable amount for the property State and proposed loan before the transaction date.
4. A simple cash-flow example
Assume you are buying a home for ₹80 lakh and taking a ₹60 lakh loan. Your transaction cash requirement is not simply the ₹20 lakh difference between price and loan. You may also need to fund property stamp duty and registration, mortgage/MODT-related costs where applicable, lender charges, and any amount the lender does not finance.
That is why a borrower with enough money for the down payment can still be short of cash at registration. Build a transaction-cost buffer before committing all available savings to the initial contribution.
Use the RiteAssetz loan eligibility calculator for an affordability starting point, but keep statutory and transaction costs outside the EMI calculation unless the lender explicitly finances an eligible component.
5. What documents can be involved around MODT?
The exact list is lender- and property-specific, but the mortgage stage can involve:
- sanction letter and accepted loan terms;
- loan agreement and security documents;
- original title chain documents identified by the lender's advocate;
- registered sale deed or other ownership document, depending on transaction stage;
- encumbrance/title search material;
- approved plan, khata/property-tax records or equivalent local documents where applicable;
- mortgage/MODT instrument or receipt, where applicable;
- proof of payment of statutory charges; and
- builder/seller documents for the relevant property type.
For the broader file, use the home-loan documents checklist.
6. When in the home-loan process does MODT happen?
The sequence depends on the lender and transaction. A typical purchase journey can look like this:
- Borrower application and credit assessment.
- Property legal and technical review.
- Sanction with conditions.
- Borrower's own-contribution and transaction-document readiness.
- Sale registration and/or mortgage-security documentation in the lender-prescribed sequence.
- Completion of pre-disbursal conditions.
- Disbursal to the permitted recipient.
For an under-construction property, disbursal may happen in stages rather than as one final payment. See the under-construction home-loan guide for that workflow.
7. MODT for a balance transfer
A home-loan balance transfer creates a new security and document-movement workflow. The incoming lender needs to understand the existing mortgage, outstanding amount, original-document custody and the conditions under which the outgoing lender will release documents.
Do not evaluate a balance transfer only on the advertised rate. Include new processing, legal/technical and mortgage-registration costs in the break-even calculation. Also map the timing carefully because the old lender's closure and the new lender's security creation have to work together.
Start with the RiteAssetz balance-transfer route and compare the total switch economics rather than the rate difference alone. For the end-to-end takeover sequence, documents and lender re-underwriting steps, use the home-loan balance-transfer process guide.
8. What happens to the mortgage after full repayment?
Loan closure should include more than the final EMI. Borrowers should obtain the lender's no-dues/NOC documents, collect original property documents held by the lender, and ensure that any registered charge or mortgage-release step applicable to the transaction is completed.
RBI directions on release of property documents after repayment apply to covered regulated-entity personal loans and set timelines and borrower-protection expectations. The exact release filing for a particular mortgage still depends on the legal structure and registration system.
Use the RiteAssetz home-loan NOC and document-return guide as your closure checklist.
9. MODT checklist before disbursal
- Get the mortgage-document name and requirement in writing.
- Confirm the payable stamp/registration amount from a current authoritative source.
- Ask whether payment must be made online, at registration, or through another prescribed process.
- Check whose names must appear on the mortgage document.
- Confirm which originals the lender will retain.
- Keep receipts, registration references and document copies.
- Confirm the post-closure release process before signing the loan package.
10. How RiteAssetz can help
RiteAssetz can help borrowers organise the home-loan file, understand lender-fit questions, compare written loan terms and prepare for legal/documentation milestones. That is particularly useful when the borrower is trying to connect eligibility, sanction conditions, property papers and transaction cash requirements in one process.
RiteAssetz does not replace the lender's legal decision or the State registration authority. The lender remains responsible for underwriting and security requirements, while statutory charges must be verified against the applicable government system.

Frequently asked questions
What is MODT in a home loan?
MODT commonly means Memorandum of Deposit of Title Deeds. It is associated with documenting a mortgage created by deposit of title deeds, subject to the legal structure used for the loan.
What is the full form of MODT in banking?
Memorandum of Deposit of Title Deeds.
Are MODT charges compulsory for every home loan?
Not in one identical form across India. Mortgage documentation and statutory charges depend on the State and the security structure used by the lender.
How much are MODT charges?
There is no reliable single India-wide rate. Verify the current State stamp/registration rules and the lender's written mortgage checklist for the actual transaction.
Is MODT different from property registration?
Yes. Property registration records the transfer or relevant property instrument. MODT relates to the lender's mortgage/security documentation.
Do I need MODT again after a balance transfer?
The incoming lender will require its own valid security. The exact mortgage documentation and charges depend on the new lender, State and legal structure.
What should I collect after closing the home loan?
Collect the lender's closure/NOC documents and original property papers, and complete any applicable charge-release or mortgage-satisfaction process.
Evidence and update note
Updated 10 September 2026. This guide intentionally avoids quoting one national MODT charge because mortgage stamp and registration treatment is State-specific. Borrower-protection guidance around original-property-document release is anchored to RBI directions. Transaction-specific statutory amounts should be verified with the applicable State registration authority and the lender's current written checklist.
Related registration checks before you sign a MODT
A MODT or mortgage-intimation step sits inside a wider property-registration and lender-security process. Before signing, make sure the underlying purchase/conveyance documents and property identity are consistent. If you are buying the property now, review the distinction between an agreement to sell and the registered sale deed. For the broader transaction cost stack, including state-specific registration charges, use the stamp duty and registration charges guide. These records serve different purposes; a MODT does not replace the conveyance, property due diligence or lender legal verification.
