Possession Letter for an Apartment and Home Loan: What Buyers Should Check Before Handover - RiteAssetz lending guide

The quick answer

A possession or handover communication from a developer is important, but buyers should not confuse it with every other document needed for a legally and financially clean property handover. Before taking possession, reconcile the developer’s offer with the applicable occupancy/completion certificate, agreement terms, dues, physical condition of the unit, conveyance requirements and your lender’s pending conditions.

Possession letter is not the same as occupancy certificate

The occupancy or completion certificate is issued by the competent authority under applicable local law. A developer’s possession letter or offer of possession is a communication in the buyer–promoter relationship. One should not be treated as a substitute for the other.

ItemWhy it matters
Offer/possession letterRecords the promoter’s handover communication and proposed possession process.
Occupancy/completion certificateRegulatory document under applicable local law.
Agreement for saleDefines contractual possession date, specifications and obligations.
Conveyance deedTransfers the relevant title/interest through the legally required instrument.
Handover recordDocuments keys, condition, meter readings and pending defects/items.

What RERA says about possession and conveyance

Section 17 of the Real Estate (Regulation and Development) Act requires the promoter to execute a registered conveyance deed and hand over physical possession in accordance with the applicable framework. The Act also links handover of project documents and plans to occupancy certification and physical possession. Section 19 gives allottees rights to information including sanctioned plans and the stage-wise completion schedule.

Buyer checklist before accepting handover

  1. Match the unit number, floor, carpet area references and buyer names with your agreement.
  2. Check whether the applicable occupancy/completion certificate has been obtained and covers your building/unit as relevant.
  3. Reconcile final demands, maintenance deposits, taxes and earlier receipts.
  4. Inspect the apartment and record material defects or unfinished items in writing.
  5. Check electricity, water, access, common-area readiness and meter details where applicable.
  6. Understand when the conveyance/sale deed and other title documents will be completed.
  7. Inform the lender if final disbursement or original-document formalities remain pending.

Why this matters for a home loan

Possession does not erase lender conditions. A lender may still need final documents, evidence of registration/conveyance, insurance or other items required under the sanction and property file. Buyers should keep the lender’s checklist aligned with the developer’s handover schedule so that the final tranche and document custody do not become last-minute surprises.

What if possession is offered before required approvals?

Do not rely only on the label used in a developer email or letter. Ask for the relevant regulatory approval and compare it with the agreement and local-law requirements. If the position is unclear or disputed, obtain independent legal advice before signing declarations that could affect your rights.

FAQ

Is a possession letter proof of ownership?

No. Ownership/title should be assessed through the applicable registered title/conveyance documents and the complete property record.

Can I take possession without checking OC or CC?

You should verify the approval applicable to the property and local law rather than relying only on the developer’s handover communication.

Does physical possession mean my home-loan documentation is finished?

Not necessarily. Final disbursement, registration, original-document custody and other lender conditions may still remain.

RiteAssetz takeaway: possession is a milestone, not a substitute for due diligence. Align the developer’s handover, statutory approvals, conveyance and lender documentation before treating the purchase as complete.
