Home Loan for a Gifted or Inherited Property in India: Ownership, Documents & Loan Options
Can you get a home loan when a property was gifted or inherited? Understand ownership records, title documents, mutation, co-heirs, renovation or LAP options and lender checks.
A gifted or inherited property can support a housing-finance journey, but the lender first needs a clear, documentable ownership trail. The key question is not simply whether the property came through a gift or inheritance. It is whether your present ownership, title chain, property records and proposed loan purpose are acceptable to the lender.

Gift deed and inheritance are not the same document trail
A property received through a registered gift deed has a different title trail from property passing through a will, succession or other inheritance process. Lenders may ask for the instrument through which title moved, earlier title documents, current property/revenue/municipal records and evidence that the person offering the property as security has the legal capacity to do so.
Do not assume that mutation, khata or a tax receipt by itself proves marketable title. These records can be important to the transaction, but legal title assessment is broader.
What lenders may check
- How the donor/deceased owner acquired the property and the prior title chain.
- The gift deed, will/probate/succession or other applicable transfer evidence.
- Whether there are co-owners, legal heirs, disputes, restrictions or existing charges.
- Current municipal/revenue/property records and tax/dues status.
- Whether the property type and location are acceptable security.
- The borrower's income, existing EMIs, credit profile and repayment capacity.
- The purpose and amount of the requested loan.
Scenario: three siblings inherit a house
Suppose three siblings inherit a house and one sibling wants to borrow against it. The fact that one person occupies the house does not automatically make that person the sole owner. The lender's legal team will look at the succession/title documents and current ownership. Depending on the facts and lender policy, participation or consent from other owners may be relevant. Resolve ownership before building a loan plan around the property.
Scenario: parents gift a flat to an adult child
If a parent has validly transferred a flat through a gift deed, the child should keep the complete title chain rather than only the latest deed. A lender considering the property will typically want to understand both the transfer into the child's name and the property's earlier ownership/approval history.

Can inherited property improve home-loan eligibility?
Owning property can strengthen your overall asset position, but it does not replace repayment capacity. A purchase-loan lender still evaluates recognised income, existing obligations, credit behaviour, requested tenure and the property being financed. Do not assume that a valuable inherited house automatically creates a larger home-loan sanction.

Frequently asked questions
Can I take a home loan on an inherited house?
The appropriate product depends on what you want to finance. If you already own the inherited house, a purchase home loan is not used to buy that same property from yourself. Renovation finance or a loan against property may be relevant depending on purpose, title and lender policy.
Is mutation enough for a bank loan?
Do not treat mutation alone as proof of complete marketable title. Lenders normally examine the broader ownership/title and property-document chain.
Can one heir mortgage inherited property?
