Stage-wise Home Loan Disbursement for Under-Construction Property in India - RiteAssetz lending guide

The quick answer

For an under-construction home, a sanctioned home loan is normally not released to the builder in one lump sum. RBI housing-finance guidance says disbursement to individual borrowers should be closely linked to construction stages and upfront disbursement should not be made for incomplete, under-construction or greenfield housing projects.

Sanction is not disbursement

A sanction letter states how much the lender is willing to lend subject to conditions. Disbursement is the actual release of money. A ₹70 lakh sanction does not mean ₹70 lakh is transferred on day one. The lender can release smaller tranches as construction progresses and documents and borrower contribution are verified.

How stage-wise disbursement works

  1. The builder raises a demand linked to a milestone.
  2. The buyer checks it against the agreement for sale and project progress.
  3. The lender may verify progress, documents and borrower contribution.
  4. If conditions are met, the lender releases the eligible tranche.
  5. The outstanding loan increases by the amount actually disbursed, not merely the sanctioned amount.

Why RBI discourages upfront builder disbursement

RBI has warned that upfront release of sanctioned individual housing loans to builders can expose borrowers and banks to project-delay, dispute and repayment risks. It therefore advises linking disbursement closely to stages of construction.

Builder demand letter: what to verify

  • Does the milestone match the registered agreement for sale?
  • Has the claimed construction stage actually been reached?
  • Does the demand separate consideration from taxes and other charges?
  • Has your required own contribution been documented?
  • Does the bank require a progress certificate or technical inspection?

Pre-EMI versus EMI

During partial disbursement, some structures require interest on the amount already released, commonly called pre-EMI, while others may permit regular EMI depending on lender terms. Read the sanction and repayment schedule to understand when principal repayment begins and how each tranche changes your obligation.

Example

Suppose a buyer has a ₹60 lakh sanctioned loan for an ₹80 lakh apartment. If only ₹15 lakh has been disbursed, the released balance is different from the full sanction. Later tranches may be released only after further milestones and conditions are satisfied.

What if construction is delayed?

Do not treat an old builder demand schedule as proof that the physical milestone occurred. Compare project progress with the agreement, RERA disclosures where applicable and lender verification. Delay can extend partial disbursement and change total interest cost.

How this fits with RERA

RERA gives allottees the right to know the stage-wise time schedule of completion and makes the agreement for sale central to payment obligations. The builder's contractual demand, actual project progress and bank disbursement should not be treated as interchangeable facts.

Borrower checklist before every tranche

  • Keep the latest builder demand letter.
  • Match it to the registered agreement for sale.
  • Check actual construction progress.
  • Keep receipts for your own contribution.
  • Confirm the amount the bank proposes to release.
  • Ask how the tranche affects pre-EMI or EMI.
  • Preserve bank disbursement advice and builder receipts.

FAQ

Can a bank disburse the whole home loan upfront to a builder?

RBI guidance says individual housing-loan disbursement should be closely linked to construction stages and upfront disbursement should not be made for incomplete projects.

Does a builder demand letter guarantee bank disbursement?

No. The lender can still require sanction conditions, borrower contribution, documentation and stage verification.

Do I pay interest on the sanctioned amount or disbursed amount?

Repayment treatment depends on the contract, but sanction and disbursement are different: money not released is not the same as an outstanding disbursed balance.

RiteAssetz takeaway: treat each tranche as a fresh checkpoint. Match the builder demand, actual construction and lender conditions before money moves.
